I don't think every state has the law of parties to which I think you're referring to, whereas everyone involved in a crime is charged the same even if they didn't kill someone and had no intention of killing someone. They weren't certain that he WAS involved in the planning. Maybe he told people she was preggo because he actually thought she was. She was even keeping some sort of pregnancy journal to make it seem real - why would she do that he if already knew she wasn't really pregnant? He did cover-up the crime, though, and that's pretty gross.

It can affect her privileges and restrictions who knows, Also just in terms of justice. I don't understand how the law is lenient in cases as bad as these, a woman had her baby carved out of her while she was still alive; imagine the pure terror she felt and not even for herself, but for her baby. Knowing she couldn't protect her baby from monsters. I can't fathom the sheer terror that would cause. And they get lenient sentences.
